Consumer-Directed Health Plans and the RAND Health Insurance Experiment
Today's consumer-directed health plans, with their high deductibles, bear a strong resemblance to the high-deductible plan of the RAND Health Insurance Experiment HIE, although they come into a post-managed care world. The high deductibles and the tools of managed care should complement each other, the former directed primarily at the...
Capping Non-Economic Awards in Medical Malpractice Trials: California Jury Verdicts Under MICRA
This monograph presents the results of an empirical study of the effects of Medical Injury Compensation Reform Act MICRA on plaintiffs' recoveries and on the liabilities of defendants in medical malpractice cases. It addresses a number of questions: How have MICRA's caps on non-economic damages affected the final judgments in...
Beyond Medi-Cal: Health Insurance Coverage Among Former Welfare Recipients
At its peak in early 1995, the welfare caseload in California reached approximately 2.7 million individuals. As of September 2001, fewer than 1.2 million Californians were receiving welfare. The unprecedented reduction in the welfare caseload has potentially serious consequences for health insurance coverage. While all welfare recipients are automatically covered...
Credit Life Insurance Premium Overcharging Litigation
Most credit life policies are "decreasing" or "declining term" in nature; that is, the insurer is obliged to pay an increasingly smaller benefit to the retailer as the purchaser's balance decreases. Once all payments have been made, coverage is terminated. The credit life insurance premium is sometimes itself financed and...
How Do Third-Party, Bad Faith Bodily Injury Claims Affect Automobile Insurance Costs and Compensation
In its 1979 decision in Royal Globe Insurance Company v. Superior Court, the California Supreme Court gave an accident victim the right to bring a claim for punitive damages against another person's liability insurer if the victim felt that the insurer had engaged in unfair claims settlement practices. Although the...
The Effects of a No-Pay/No-Play Plan on the Costs of Auto Insurance in Texas
The cost of automobile insurance has been a major public policy issue for more than a decade. To obtain the savings, states would have to limit the rights and compensation traditionally provided to people injured in auto accidents. Recently, a new concept has emerged called "no-pay/ no-play," which limits the...
Effects of Access to Post-Retirement Health Insurance on Retirement Behavior and Insurance Coverage
RAND researchers Lynn Karoly and Jeannette Rogowski find that policy initiatives that aim to increase access to affordable post-retirement health insurance are likely to motivate some of the near elderly to retire early. In addition, with more options for obtaining post-retirement insurance, insured workers who do retire early are more...
Costs of a Medicare Prescription Drug Benefit: A Comparison of Alternatives
Medicare is the only large health insurance carrier that does not include an outpatient prescription drug benefit. This exclusion is particularly important because the elderly are among the biggest consumers of pharmaceuticals. Medicare beneficiaries comprise 13 percent of the U.S. population, yet account for over 36 percent of total outpatient...
