Henry Ergas, Vice President, has extensive international experience advising government bodies and major corporations in Australia, New Zealand and the European Union. Prior to joining CRA, he was the founder and Managing Director of the Network Economics Consulting Group (NECG) Pty Ltd. Having spent a decade as a microeconomist at the OECD, Mr. Ergas has a strong background in the analysis of issues involving efficient resource allocation. At the OECD, he headed the Secretary-General's Task Force on Structural Adjustment, which concentrated on improving the efficiency of government policies in a wide range of areas. As part of this work, he has examined the design of systems for allocating scarce resources in contexts that go from the allocation of R&D funds through to the design of congestion charging. His work on innovation policies, originally carried out at the OECD, has been influential in the design of R&D policies in a wide range of countries. Since leaving the OECD, Henry's work has focused on competition policy and regulatory economics. He has been closely involved in dealing with regulatory issues in a range of industries, including telecommunications, electricity, aviation, surface transport, and financial services. He served as Visiting Economic Adviser to the Trade Practices Commission (now the Australian Competition and Consumer Commission) and has subsequently been involved in a number of significant competition policy cases, providing expert statements and appearing as a witness in major access arbitrations and competition law proceedings. He chaired the Australian Intellectual Property and Competition Review Committee set up by the Australian Federal Government in 1999 to review Australia's intellectual property laws as they relate to competition policy. In July 2001, Mr. Ergas was appointed by the Attorney General of New Zealand as a lay member assisting the New Zealand High Court in cases involving appeals from decisions of the Commerce Commission and in other matters under the Commerce Act. In March 2004, he was appointed as a member of the Australian Centre of Regulatory Economics (ACORE) Advisory Group, which advises the Board on matters pertaining to regulatory activities. Jan Paul Acton, Vice President, is a recognized expert in the economics of electricity and other forms of energy, environmental economics, and telecommunications. Dr. Acton provides analysis, litigation support, and testimony for antitrust and competition analysis, restructuring and pricing matters, penalties and damages assessment, contract disputes, and cost allocation. Specific environmental experience includes cost and penalty analysis under Superfund, RCRA, and other statutes. Antitrust and competition analysis includes disputes over supply and pricing behavior in wholesale electricity markets as well as appropriate retail rates. His experience in the energy sector includes co-directing a large experiment with peak-load pricing in Los Angeles, which resulted in mandatory time-of-day electricity rates for large customers and optional rates for others, as well as studies of consumer demand for electricity and forecasts of electricity demand. He has testified frequently before regulatory and governmental bodies in the U.S. and Canada. He has published extensively in academic and other publications. Mr. Steadman is a director in the London office of Lee & Allen, and has more than ten years of experience specializing in forensic accounting. He has acted on many complex fraud and expert witness assignments in a number of jurisdictions, particularly in Central and Eastern Europe. Beginning in 1999, he was appointed by the Secretary of State for Trade and Industry as an inspector in matters of insider dealing. He also worked for the Department of Trade and Industry, where he conducted and oversaw inquiries into limited companies for the Companies' Investigation Branch. Mark Fidelman combines 20 years of experience working in the financial services industry with six years of transfer pricing consulting. Since 1999, Mr. Fidelman's primary practice has been in the economics of intercompany pricing to financial services firms. His specializations include reinsurance transfer pricing, allocation of income between locations involved in the trading of financial instruments, compensation to capital for company and loan guarantees, and establishing premiums for self-insurance transactions. Mark P. Berkman, Vice President, specializes in the application of economics to environmental, energy, intellectual property, antitrust, labor, and public finance matters. Mr. Perry J. Urken specializes in the economic analysis of intercompany pricing and other taxation issues, including the valuation of intangible assets, IRS audits, cost-sharing arrangements, and global tax optimization strategies. Recently, Mr. Urken directed and managed a major study for a FORTUNE 100 consumer products company that identified the relative shares of profits attributable to trademark ownership and marketing functions based on economic analyses of trademark licensing arrangements between third parties. He has also performed economic analyses of trademarks and other intangible assets owned by firms in the construction, consumer products, pharmaceutical, and computer industries for the purposes of documenting the arm's length nature of intercompany royalty rates. Prior to joining CRA, Mr. Urken held a manager position with the Economic Consulting Services practice of KPMG, where he managed a number of transfer pricing and valuation engagements for multinational clients. Paul Paterson, Vice President, joined CRA from NECG and has significant commercial and government experience in industry research, corporate strategies, and policy development, as well as senior executive experience in the telecommunications industry. Prior to joining NECG, Dr Paterson was with Telstra Corporation Ltd, where as Director, Regulatory, he held one of Australia's most influential regulatory positions. In this role, he managed all regulatory proceedings on behalf of Telstra, and was a key industry player in establishing and implementing the current competition regulatory framework for telecommunications in Australia. As a founding member and convener of the Regulated Industries Forum since 2003, Dr Paterson also has extensive insight into regulatory issues in the utilities and transport sectors. Prior to his appointment as Director Regulatory, Telstra, Dr Paterson was the Group Manager Competition, Regulatory and External Affairs, Telstra. William Babcock, Vice President, has 25 years of experience in consulting and economic research for clients in the power and energy industries. Dr. Donath is an associate principal at CRA (formerly Lexecon Ltd) and has extensive experience in applying quantitative techniques to economic litigation matters. His current projects include advising large multinational companies in the U.K. and Slovakia on acquisitions and estimating damages for several clients in Commission cartel investigations. In addition, while at Lexecon, Dr. Donath was involved in numerous cases, including abuse of a dominant position in a pharmaceutical industry, theoretical and numerical modeling of the impact of the merger on the likelihood of licensing, and a merger in the radio industry. Prior to joining Lexecon, Dr. Donath was a manager in Deloitte's Economic Consulting practice in Washington, D.C., where most of his work focused on the telecommunications and financial services industries. This, for example, included advising a Regional Bell Operating Company on a dispute over third-party billing fees, developing and estimating an economic damages model related to market timing allegations for several clients in the U.S. mutual fund industry, estimating damages in a breach of insurance contract in an asbestos-related dispute, and providing advice on a fair lending dispute over bias in automobile financing. Dr. Donath also has work experience in transfer pricing and is a native speaker of Czech.

Mr. Burger has worked in the commercial sector for the past twenty-one years. In 1985, he was recruited from the police service after ten years service, predominately as a detective. He was a senior member of Network Security Management Limited; the leading London based counter fraud and investigative firm, from the mid-1980s. He became managing director of the Network Group responsible for its companies in London, New York, Berlin, Oslo, and Stockholm. His career followed and contributed to the development of commercially available resources to assist business and financial institutions in combating increasingly complex and sophisticated commercial and financial crime. For the past 15 years Mr. Burger has successfully managed major, often sensitive, projects on behalf of leading corporations, financial institutions, and overseas governments throughout the world, typically advising chief executives and legal counsel in the implementation of investigations and financial recovery strategies.

Fiorenzo Bovenzi is a senior associate in the Competition practice at CRA International. He has experience in the areas of economic regulation, modeling, competition policy, and damage estimation in the energy industry. Prior to joining CRA, Mr. Bovenzi spent two years with NERA Economic Consulting in London, where he worked on a wide range of projects in the electricity and gas sectors. Major projects included a comparative study of electricity markets in twenty jurisdictions, an econometric assessment of the potential benefits of fuel diversity in Northern Ireland, and a study into the effects on Northern Ireland of the new arrangements in the electricity market of the Republic of Ireland. At NERA, Mr. Bovenzi also contributed to a simulation of how competitive electricity markets work in several countries (including the Netherlands, Spain, Bulgaria, and Singapore) using game-theoretical models. He also worked on other projects in the areas of competition policy and public policy. In 2002, Mr. Bovenzi completed a two-year master's program in economics and finance at Centro de Estudios Monetarios y Financieros (CEMFI) in Madrid, Spain, where his thesis dealt with the Spanish electricity market.

Professor Flavio Menezes joined the University of Queensland in June 2006 as Chair of Economics after more than a decade at the Australian National University, where his many responsibilities included the position of Foundation Director of the Australian Centre of Regulatory Economics. He has published widely in the economics of information and uncertainty and is regarded as Australasia's leading auction expert. He has extensive teaching experience in the areas of game theory, industrial organization, regulatory economics, and in the theory of incentives. He has presented at seminars and delivered lectures in the Americas, Europe, and in the Asia Pacific region, and has lectured to both academic audiences and practitioners. His international consulting experience includes serving as the main advisor on the determination of a privatization model for utilities, providing advice on electricity regulatory reform, and reviewing government procurement practices. Consulting experiences in Australia include advising the Australian Competition and Consumer Commission (ACCC) on the application of auction theory to regulatory environments and providing economic advice to various organizations on mergers and competition policy cases and regulatory issues in defense, energy, health, transport, and telecommunications. Professor Menezes was formerly a part-time vice president with the Regulatory Economics and Public Policy practice at CRA International in Canberra. He currently retains an informal relationship with CRA as a senior consultant working on various projects on an ad-hoc basis.

Dr. Geoff Edwards is a principal with extensive experience in competition and regulatory issues both as an economist and as a lawyer, and particular expertise advising clients in the telecommunications sector. Prior to joining CRA (formerly Lexecon Ltd) in October 2004, Dr. Edwards worked as an economic analyst in the telecommunications branch of Australia's competition and utilities regulator (the ACCC), and then as a competition lawyer at a major Australian law firm, advising Australia's incumbent telecommunications operator (Telstra) on competition and regulatory matters (including investigations of alleged abuses of market power and negotiations and arbitrations concerning access and interconnection pricing for fixed and mobile services). He has published numerous papers and presented to many forums on issues in competition and regulatory policy, including abuse of market power and predatory pricing, and has been cited with approval by the Federal and High Courts of Australia. His most recent academic writings have concerned the political economy of telecommunications regulation.

Gopal Das Varma has extensive research and teaching experience in theoretical and empirical industrial organization. While on the faculty at Duke University's Fuqua School of Business, he has taught M.B.A. courses on imperfect competition, law and economics, and game theory, involving topics such as monopolization, market entry, horizontal and vertical mergers, tacit collusion, signaling, vertical restraints, tying arrangements, hold-up, contracts, auctions and price discrimination. While teaching, he has written, or led discussions of, cases drawn from such diverse industries as express mail, motion pictures, video rentals, beer, cosmetics, pet food, electronic equipment, photographic materials, and industrial supplies. As a graduate student at Northwestern University, he has taught undergraduate courses on statistics, applied econometrics, and microeconomics. In addition to his research on the theory of auctions and markets, he has analyzed data from the U.S. Forest Service's auction of timber harvesting rights and the U.S. Department of Interior's auction of offshore oil and natural gas. His research has been published in such leading journals as The RAND Journal of Economics and the International Journal of Industrial Organization. His expert opinion as a referee is regularly sought by the leading journals in economics and management, including Econometrica, Journal of Economic Theory, Journal of Law, Economics and Organization, Journal of Industrial Economics, Journal of Economics & Management Strategy, Management Science, and The Energy Journal. He has given invited talks at universities like Harvard, Northwestern, Wisconsin-Madison, Vanderbilt, Toronto, and British Columbia, and at prominent conferences like the Econometric Society World Congress and annual conferences hosted by the Center for the Study of Industrial Organization.

Dr. Hugh Wills is a principal with CRA (formerly Lexecon Ltd). Prior to joining the firm, Dr. Wills was a lecturer in economics at Sussex University and the London School of Economics from 1977 to 2000 and a visiting faculty member at the Australian National University and the University of California. At the LSE he taught microeconomics, industrial economics (including regulation and competition law) and econometrics (theoretical and applied). He has published on industrial economics and regulation, pricing in the computer industry, and theoretical econometrics. Both before and since joining CRA (formerly Lexecon Ltd) in 2000 he has advised on a number of cases before the OFT and MMC and the European Commission.

Kate Sullivan is an associate principal in the Transfer Pricing practice in Boston. Laurence Schumann is a senior managing economist in LECG's Washington, DC office. Dr. Schumann specializes in industrial organization and antitrust economics. His work has focused on the antitrust analysis of mergers and acquisitions and various business practices such as price fixing, tying, exclusive dealing, and other horizontal and vertical restraints. He has also calculated economic damages in matters involving a wide range of commercial litigation. Dr. Schumann has testified in US district court and in arbitration proceedings, and has published articles in a number of leading economic journals. Dr. Schumann has over twenty years experience as an antitrust economist. He spent more than ten years as an economist on the staff of the Federal Trade Commission, where, as a member of the staff of the Division of Economic Policy Analysis, Bureau of Economics, he conducted economic research on the competitive effects of proposed state and federal regulations. His analyses were submitted to state legislatures, federal agencies, and Congress as part of the Federal Trade Commission's Competition and Consumer Advocacy Program. Dr. Schumann also assisted in the antitrust investigations of corporate mergers and business practices, and acted as an expert witness. Since leaving government service, Dr. Schumann has been an economic consultant for Glassman-Oliver Economic Consultants, CRA International and LECG. He has experience in a wide range of industrial and consumer manufacturing industries and service industries. A partial list of the industries analyzed by Dr. Schumann includes medical devices, pharmaceuticals, hospitals, software, chemicals, packaging, paper and paperboard, transportation, textiles, telecommunications, building and construction materials, electrical equipment, steel, and mining.

Liga Bauer-Hoy is a principal in the Transfer Pricing practice in CRA's Palo Alto office. Ms. Bauer-Hoy has extensive experience applying strategic, international trade, theoretic literature and game theoretic methods to provide analyses of international tax competition. Throughout her career, she has performed valuations of intangible assets (including trademarks and in-process intangibles associated with Cost Sharing Agreements), and also applied real options analysis to Cost Sharing Agreements. Her expertise also includes international, sovereign, and company credit-risk analysis; nonlinear econometrics; computer modeling; and technical writing. Prior to joining CRA, Ms. Bauer-Hoy was a senior economist at the Internal Revenue Service, where her varied engagements included conducting technical transfer pricing analyses that supported IRS examinations and prospective Advanced Pricing Agreements for large multinational companies, as well as developing revised, 482 cost-sharing regulations with the U.S. Treasury, Office of Tax Analysis, and IRS Office of Chief Counsel. Ms. Bauer-Hoy speaks English, German, Russian, and Latvian.

Madeleine Forsyth joined the CRA International Forensic Computing practice from the Lee & Allen Forensic Computing Services group following the acquisition of Lee & Allen Consulting Limited in April 2005. Madeleine had been part of the Lee & Allen Forensic Computing Services group since May 2002, prior to which she spent one year conducting forensic computing investigations whilst working as an IT security analyst at WorldCom International, and a year working as a security administration analyst at the Liverpool Victoria Friendly Society. Matthew Gilham is a principal with the Corporate Investigations and Fraud Management practice based in London. He has over fifteen years' experience in the deterrence, detection and investigation of fraud and malpractice. For the five years prior to joining CRA International, Mr. Gilham was the fraud prevention manager for a major U.K. insurance company. He developed successful counter fraud strategy and implemented tactical solutions and operational processes to combat both corporate and volume (external) fraud resulting in multimillion pound savings. Mr. Gilham was previously an associate director with a leading corporate fraud consultancy where he managed risk assessments and fraud investigations for blue chip corporate and public sector clients. This included a two year secondment to Scandinavia and major assignments in Europe, the United States, Asia, and Australia. He has also worked for the enforcement divisions of the London Stock Exchange (Insider Dealing Team) and Securities & Futures Authority (now the Financial Services Authority). A regular conference presenter, Mr. Gilham is also a guest lecturer in the Certificate of Fraud Management for the University of Teesside Business School.

Paul Milgrom is Shirley R. and Leonard W. Ely, Jr., Professor of Humanities and Social Sciences and Professor of Economics, Stanford University. He is also a founder of MDI and a Senior Consultant to CRA. Together with Robert Wilson and Preston McAfee, Professor Milgrom designed the mechanism used by the FCC for its spectrum auctions. More recently he has led or supported auction design project teams for new FCC spectrum auctions and for spectrum auctions and electric utility auctions in various countries, including the United States, Mexico, Canada, and Germany. He has advised bidders in other auctions. Professor Milgrom has published widely on auctions and related topics, and lectured on "Putting Auction Theory to Work" as part of the 1996 Nobel Prize week activities. Dr. Penelope Papandropoulos, Principal, has worked on a variety of merger and other competition cases both before the EU Commission, the European Court of Justice, and national competition authorities (in France, Slovakia, South African and the U.K.). The merger cases she has worked on before the European Commission include Tetra Laval/Sidel, Totalfina/Elf, Framatome/Siemens, and merger cases before the U.K. Competition Commission include Royal Caribbean/P&O and Reed Elsevier/Harcourt. In addition, she has worked on Article 81 and Article 82 cases as well as commercial litigations, trade disputes, regulatory disputes, and State Aids (e.g. Alstom). Apart from analyzing market definition issues and assessing the competitive impact of mergers, her work has covered a large number of economic issues, such as the assessment of evidence on the existence of a cartel, the evaluation of damages in a trade dispute, the preparation of economic evidence in commercial litigations, the assessment of the impact of vertical agreements, and the calculation of access prices. In 2001 2002, she was involved in the analysis of conglomerate effects in the Tetra Laval/Sidel merger.

Mr. Mudge is a principal with 15 years of experience in corporate and project finance within the energy industry. Dr. Barnes is a principal in CRA International's Financial Economics practice in London. Prior to joining CRA, he was associate dean, finance programs at London Business School, where he previously served as assistant professor of accounting. During his time at the school, he taught on almost all of the school's degree programs, and also taught practitioner courses for various organizations including a number of major financial institutions in addition to serving for several years as an examiner for the ICAEW. His teaching experience includes courses on financial accounting, corporate finance and valuation, finance theory, accounting for investment banking transactions, and derivative securities. His research interests center on the relationship between accounting information and capital markets, with a particular emphasis on accounting for derivatives, as well as accounting for mergers and acquisitions.

Dr. Sam Dinkin is Chief Economist at Optimal Auctions, Inc. as well as a long-time space settlement advocate and a prolific writer on space settlement issues . A very extensive collection of space articles written by Sam, for example, has been published by The Space Review since that online space magazine's debut. Among the many space-related activities in which Sam is involved, he is the Founder of SpaceShot, Inc. (a suborbital "fair shot" space lottery company), is on the Advisory Board of the Colony Fund, and is the Sponsor of the Space Journalism Prize and founding member of the Space Journalism Association. He is also an investor in early-stage space start-up companies. During his tenure with Optimal Auctions, Sam has designed and implemented auctions worth over $90 billion, including all of the electricity for New Jersey rate payers since 2002. He is a former research staff member at IBM's Watson Research Laboratory, and, as auction consultant for the Law & Economics Consulting Group (LECG) and Charles River Associates (CRA), led bid strategy for Qualcomm in Brazil. On March 27, 2005, Sam was interviewed by The Space Show. During this interview (his second with The Show), he discussed a wide variety of space issues with the show's host, from lunar commerce, to China's space program, to the Law of the Sea Treaty and its effect on space development.
