Clarence Smith, Jr. joins Connell Foley LLP after several years of service as Assistant Chief Counsel to the United States Department of Homeland Security. An authority on immigration law, Mr. Smith brings to Connell Foley extensive experience in exclusion, deportation, removal and rescission proceedings and in matters involving civil document fraud. At Connell Foley, Mr. Smith leads an Immigration Law practice which is an important component of the firm's comprehensive Labor and Employment Law services. Mr. Smith is available to counsel employers regarding such matters as working visas, labor certifications, green card applications. In addition, Mr. Smith can assist employers in complying with the United States Department of Labor and Department of Homeland Security requirements regarding non-citizen employees. Mr. Smith regularly serves as an arbitrator before the National Association of Securities Dealers.
Mr. Foley was Surrogate of Essex County from 1954 to 1958 and has held many offices in Bar Associations, including President of New Jersey State Bar from 1964 to 1965. He was State Delegate and Member of the Board of Governors of the American Bar Association, as well as Chairman of the ABA Litigation Section, and Chairman of the ABA Commission on Advertising. He is a fellow of the American College of Trial Lawyers, as well as the American College of Trust and Estate Counsel, a past Director of the American Judicature Society, a present member of the American Law Institute, and a permanent delegate to the Third Circuit Judicial Conference. In 1966, he served as President of the State of New Jersey's Fourth Constitutional Convention. He was Treasurer and original Commissioner of the New Jersey Sports and Exposition Authority's Sports Complex. For many years, Mr. Foley was a Member of the Board of Directors of Prudential Life Insurance Company and Chairman of both the Executive and Finance Committees. He is a Director of ESBI International and the New Jersey State Chamber of Commerce, Executive Committees. A past President of the New Jersey State Golf Association, he is also its General Counsel. Mr. Foley is a past Member of the United States Golf Association Regional Affairs Committee. He has served on the Board of Trustees of Seton Hall College, St. Peter's College, Immaculate Conception Seminary and St. Benedict's Preparatory School. He also served on the Columbia Law School Board of Visitors.

After serving a judicial clerkship, Mr. Kenny joined the firm and has been a partner since 1968. He is one of only a few lawyers who have been invited to membership as a Fellow of the American College of Trial Lawyers, a Diplomate of the American Board of Trial Advocates and a Fellow of the American Bar Foundation. He has served on and chaired numerous New Jersey Supreme Court Committees, including those dealing with the medical profession, attorney fees, civil case management reform, minors' funds, the media, court reporting and law firm identification. He has also served as a District Ethics Committee member and chair of the Committee. For fifteen years, he served the Court as chair of the Supreme Court Committee on Attorney Advertising and as a member of the Court's Committee on Professional Responsibility Rules. Mr. Kenny is an Adjunct Professor of Law at Rutgers University School of Law in Newark and for several years has served as a member of the editorial board of the New Jersey Law Journal. With former Connell Foley partner Frank A. Lattal, he has authored the standard insurance text, New Jersey Insurance Law, first published in 1993 with a Second Edition published in 2000. He is recognized as one of the premier litigation specialists in New Jersey, having tried more than 400 cases to conclusion and briefed or argued almost 100 reported Appellate Division and Supreme Court cases. He has lectured and written extensively on litigation, both as to procedure and substance in numerous fields of law. Mr. Kenny has been recognized by the New Jersey Supreme Court as a certified civil trial attorney since the initial certification of attorneys in the early 1980's. He has also served consecutive terms as a trustee on the Board of Essex County College, including a term as chair of the Board, consecutive terms as member and chair of the Montclair Zoning Board of Adjustment, and served on the Board of the Legal Services Foundation of Essex County. Mr. Kenny is a member of the American Bar Association and served as one of fifteen members on the Association's Standing Committee on the Federal Judiciary which investigates, evaluates and votes on the qualifications of federal judicial nominees to the United States Supreme Court, Circuit Courts of Appeal and U.S. District Courts. He is a longtime member of the Association's Litigation Section and has served on its Council, as a Division Director and as chair of the Professional Liability Litigation Committee, Insurance Coverage Litigation Committee and as liaison to the ABA for attorney certification. Mr. Kenny is also a member of the New Jersey State Bar Association, where he has served three terms as trustee, and the Essex County Bar Association in which he has held numerous offices including president of the Association. Mr. Kenny represents clients in a broad range civil litigation cases and tort liability matters, including insurance, product liability, medical and professional malpractice, construction defect and employment law in both the state and federal courts.

Mr. Rhatican is a partner in Connell Foley's real estate section. Mr. Rhatican represents primarily developers of real estate, both in the acquisition and sale of properties and in the permitting, financing and development process. Mr. Rhatican is experienced in acquiring, selling and developing properties of all sorts, including properties impacted by adverse environmental conditions, including Superfund sites, and the due diligence and ISRA issues associated therewith. He has represented numerous redevelopers of blighted properties and has assisted clients in obtaining tax abatements and public financing for such projects. Mr. Rhatican also has worked with various other regulatory state and local agencies on a variety of projects, including those impacted by Highlands, wetlands, Meadowlands, CAFRA and waterfront development and other regulations. He also has obtained subdivision, site plan and related permits and approvals for projects of nearly every size and character throughout the State including industrial, retail and office uses, housing projects and others. Mr. Rhatican has handled litigation arising from real estate issues, including litigation arising from real estate transactions and regulatory takings cases. He is presently a member of Essex County, Hudson County, New Jersey State and American Bar Associations. He serves on the Executive Committee of the Worrell Mountain Inn of Court. He has written several articles and contributed to publications on a variety of real estate and other topics.
John P. Lacey, Esq., a partner at Connell Foley LLP, recently served as a Legal Analyst on the MSNBC News Television Network during MSNBC's coverage of the "Battle for the White House 2000." Mr. Lacey, a former federal prosecutor, concentrates his practice in the areas of complex litigation, white-collar criminal litigation, employment litigation and corporate investigations. In 1993 and 1994, Mr. Lacey served as Special Counsel to the New Jersey Republican State Committee. In that capacity, Mr. Lacey had defended the Republican Party against the various civil lawsuits and the federal and state criminal investigations that arose from the 1993 election of New Jersey Governor Christine Todd Whitman. At Mr. Lacey's request, all of those matters were ultimately dismissed. Indeed, prosecutors took the unusual step of issuing a Report that publicly exonerated both Governor-elect Whitman and the Republican Party of any wrongdoing. After the litigation was concluded, Mr. Lacey served as outside counsel to the Republican State Committee. During the recent MSNBC coverage, Mr. Lacey offered his insights concerning the complex web of lawsuits brought against Florida state and county officials and the legal and public relations steps necessary for Governor George W. Bush and Vice President Al Gore to win the recent election for President of the United States.

Mr. Pizzi has been with Connell Foley since 1983 after practicing at large firms in New York City and Denver. Mr. Pizzi's practice is devoted primarily to business and employment litigation, securities litigation and SRO arbitration, and the protection of corporate intellectual property. In recent cases, Mr. Pizzi lead a team performing an internal investigation of whistleblower claims by a former employee of one of New Jersey's largest insurance and financial services companies; defended a consumer class action which presented issues under the Class Action Fairness Act and a class-action waiver clause; obtained dismissal of a Sarbanes-Oxley whistleblower complaint; obtained a favorable jury verdict defending a college professor's claims of sex discrimination; tried to a favorable federal court jury verdict an unfair competition case; succeeded at trial in a minority shareholder's squeeze-out lawsuit; and successfully represented corporate officers in securities class actions and related SEC investigations.

Mr. Smith became a partner in 1989. During his career with the firm, Mr. Smith's practice has been devoted primarily to litigation and arbitration of construction disputes. Mr. Smith is Co-Author of Representing the Contractor in Defense of Owner Claims, in Construction Litigation: Representing the Contractor, Wiley Law, Second Edition (1992). He is a Member of the New Jersey State (Construction and Public Contract Law Section, serving as Chairman from 1993 through 1995) and American (Member, Public Contract Law and Litigation Sections and ABA Forum on the Construction Industry) Bar Associations. Since 1995, Mr. Smith has been a member of the Construction Industry Panel of Arbitrators for the American Arbitration Association. In 1999, Mr. Smith was selected by the American Arbitration Association to serve on its New Jersey Public Sector Panel of Mediators and Arbitrators. He has served on a variety of construction industry arbitration panels, deciding claims involving major public and quasi-public construction projects and surety matters.
Mr. McGovern served as Law Secretary to Hon. Alfred M. Wolin, U.S. District Court, District of New Jersey, 1984-1985. He is Secretary, Supreme Court of New Jersey District Ethics Committee and a Member of the Essex County, Hudson County, New Jersey State (General Practice Section) and American (Sections on Real Property, Probate and Trust Law and Business Law) Bar Associations.
After being elected to the post last year, Roseland attorney and Morristown resident Richard J. Badolato is beginning his second year as first vice president of the New Jersey State Bar Foundation, an organization dedicated to promoting law-related education and giving all New Jersey residents a basic understanding of the legal system. A past president of the New Jersey State Bar Association, Badolato has been a member of that organization for 40 years. He has served on the General Council since 1977, the Civil Trial Bar Section's Executive Committee since 1982 and the Certified Trial Attorneys Section since 1988. Badolato served as chair of the NJSBA Committee on Reinstatement of Attorneys and was a member of the ad hoc Committee on Professionalism and the Membership, Malpractice and Auto Insurance Reform committees. Currently the chair of the Judicial and Prosecutorial Appointments Committee, Badolato serves as vice chairman of the Supreme Court's Advisory Committee on Professional Ethics and received the Civil Trial Bar's James J. McLaughlin Professionalism Award in 2006. He served as an NJSBA trustee from 1993 to 1999 and is a past chair of the New Jersey Commission on Professionalism. Badolato served as president of the Essex County Bar Association from 1977 to 1978. He is the New Jersey chair of the Fellows of the American Bar Foundation, a diplomate of the American Board of Trial Advocates, and served as a member of the ABA House of Delegates from 1978 to 1990. In addition to his bar association involvement, Badolato served on the Supreme Court of New Jersey Professional Responsibility Rules and the Paralegal Education and Regulation committees. He was also a member of the Unauthorized Practice of Law Committee where he served as chair from 1997 to 2000. Badolato serves as a special arbitrator in civil matters for both Union and Middlesex counties and is a member of the New Jersey Supreme Court Advisory Committee on Professional Ethics. He is a master of the Richard J. Hughes American Inn of Court, and a member of the International Society of Barristers and the International Society of Defense Counsel. Badolato is a partner in the Roseland law firm of Connell Foley LLP. A certified civil trial attorney, he practices in both state and federal courts, handling malpractice, products liability, all forms of general liability, construction and automobile litigation, insurance coverage and policy interpretation, fire and theft losses, and declaratory judgment proceedings. Badolato is also a member of his firm's Litigation Partners Executive Committee. A graduate of Fairfield University in Connecticut, Badolato received his law degree from Rutgers Law School Newark. Badolato is the founder and past president of Fairfield University's New Jersey Area Club. He also was honored in 1997 as the recipient of Fairfield University's Alumni Service Award.

Robert E. Ryan is Managing Partner of the Professional Liability Practice Group and a Senior Litigator at Connell Foley LLP. A three-time Certified Civil Trial Attorney as certified by the Supreme Court of New Jersey, Mr. Ryan has dedicated his professional practice for over 25 years to the litigation and trial of substantial matters. Mr. Ryan's practice places particular emphasis on the representation of architects, engineers, attorneys and physicians in major professional malpractice litigation. William H. Graham, a partner with Connell Foley LLP, has joined the National Center for State Courts' Lawyers Committee, which involves prominent practicing attorneys in the National Center's work and programs. Ms. Antonian was a member of the Seton Hall Constitutional Law Journal (1998-2000) and is the author of, 'First Amendment-Government-Owned Broadcasters Retain The Right to Control Political Candidates' First Amendment Right Of Access to Sponsored Debates, Arkansas Educational Television Commission v. Forbes, 523 U.S. 666 (1998), 10 Seton Hall L.J. 493 (2000). Ms. Antonian worked for Keyspan Energy Corp. from 1993-1999, managing all aspects of environmentally impaired properties, including Brownfield Redevelopment and resale of impaired properties. Ms Antonian interfaced with the regulatory agencies to ensure cooperation and environmental compliance.
Ms. Iuso was a Law Clerk to Hon. Nicholas Scalera, Superior Court of New Jersey, Appellate Division, from 1987-1988. Ms. Iuso was a Barrister in the William J. Brennan, Jr., Chapter of the Essex County Inn of Court from 1995 to 1997. Ms. Iuso is a member of the New Jersey, New York and American Bar Association.
BIOGRAPHY: Prior to joining Connell Foley, LLP, Mr. Celii served the County and State of New York as an Assistant District Attorney. He prosecuted a broad range of cases including: fraud, grand larceny, forgery, narcotics trafficking, gun possession, obstruction of governmental administration and assault. Mr. Celii worked as a Legal Intern for the United States Attorney's Office for the District of New Jersey. He also served in the United States District Court of New Jersey as a Judicial Intern to the Honorable Alfred M. Wolin, United States District Court Judge.
Ms. Bevelock O'Reilly was a Staff Member (1990-1991) and Articles Editor (1991-1992) of the St. John's University Law Review. She was a Law Clerk to Honorable Nicholas H. Mr. Judge practices primarily commercial litigation in the federal court in New Jersey. Known for his versatility, over the past year his diverse practice has found him arguing antitrust, intellectual property and contract issues before the federal court on behalf of various business clients; Fifth Amendment takings issues before the Court of Federal Claims; UCC, fraud, construction and products liability issues before the New Jersey state courts on behalf of bank, construction and manufacturing clients; Commerce Clause issues in a class action before the New Jersey Tax Court on behalf of trucking industry clients; and inherently beneficial land use issues before a city Zoning Board of Adjustment on behalf of a homeless shelter; all while serving his hometown as municipal prosecutor. Early on, Mr. Connell devoted much of his time and energy to courtroom litigation. He then took over management of the trial staff when Robert Shaw left to become a federal judge. Through his work with the New Jersey Manfacturers Insurance Company and other clients, he developed an expertise in insurance law, which led to his being asked to join a working group of business leaders charged with examining New Jersey's auto insurance system and proposing improvements. Today's no-fault law was the product of the working group sessions to which Walt contributed his expertise.

During his career with Connell Foley, he has been involved in a wide array of litigation cases, including complex commercial, breach of contract, insurance defense, personal injury, products liability, construction and professional liability matters. Mr. Peterson participates in all aspects of litigation, including initial case assessment; discovery drafting; fact, expert and corporate designee depositions; trial preparation; trial and appellate practice; and motion practice including temporary restraining orders and orders to show cause seeking equitable relief. During his law school career, Mr. Peterson was a member of the Public Interest Law Journal at Boston University School of Law, and authored several articles for that publication.
Mr. Marx is a member of the New Jersey and New York Bars and the United States District Court for the District of New Jersey. Mr. Marx is also a member of the Essex County and Morris County Bar Associations and is a member of the Morris County Bar Association Trust and Estates Committee.

Prior to joining Connell Foley, Judge Bissell served 27 years on both state and federal courts in New Jersey. Appointed a United States District Judge for the District of New Jersey in 1982, he served in that capacity until his retirement on September 1, 2005. From 2001 until 2005, Judge Bissell was Chief Judge of the Court. From 1981-1982, he served as Judge, Superior Court of New Jersey, and from 1978-1981 he was Judge, Essex County, New Jersey District Court. In the years before he was appointed to the judiciary, Judge Bissell served as an Assistant United States Attorney, District of New Jersey (1969-1971), and was in private practice as an associate and partner with a large New Jersey firm (1966-1969; 1972-1978). Judge Bissell began his legal career as Law Clerk to U.S. District Judge A.S. Lane, District of New Jersey from 1965-1966. Judge Bissell's diverse experience has made him a sought-after speaker at a variety of events. He has recently delivered the Chief Justice Joseph Weintraub Lecture: A Tribute to the Weintraub Court at Rutgers University Law School in Newark (2002). He also spoke at the Professional Awards Ceremony of the New Jersey Commission on Professionalism in the Law: Good Sportsmanship and Professionalism (2003), and delivered the Hon. Robert N. Wilentz Justice Forum Lecture: The Megan's Law Litigation: A Study in Principles of Separation of Powers and Federalism (2003). Judge Bissell's outstanding reputation is also demonstrated by the professional recognition he has been accorded. Notably, he is a recipient of the 2005 John F. Gerry Memorial Award from the Camden County Bar Association; the 2005 Association of the Federal Bar of the District of New Jersey William J. Brennan, Jr. Award; the 1988 Princeton University Class of 1962 award for Distinguished Public Service; and the 1971 U.S. Attorney General's Meritorious Service Award. His work was recently recognized with a Lifetime Achievement Award from the Seton Hall University School of Law Public Interest Network. Judge Bissell is a member of Union Congregational Church in Montclair, New Jersey. He has also earned a reputation in Montclair as one of the Dapper Dans of Harmony the barbershop harmony chorus of which he has been a member since 1982. Judge Bissell also maintains an avid appreciation for sports officiating, and is a Member of the Board of Directors of the National Association of Sports Officials. He has been affiliated with the National Ice Hockey Officials Association's Metropolitan New York Chapter since 1972, and served as a referee of High School and Division III College Ice Hockey until his retirement in 1999.

Mr. McHenry is a partner in the firm's Business Litigation Department. His accomplishments prior to coming to Connell Foley LLP include serving as a research assistant at the United Nations Center for Human Rights in Geneva, Switzerland, and as a speech writer for Lt. Governor Nick Theodore of South Carolina. During law school, he was selected to represent Emory School of Law as a member of Moot Court Special Teams.
Mr. DeBlasio's entire career has been devoted to the representation of employers in labor and employment-related matters. In particular, Mr. DeBlasio represents employers in all types of employment-related litigation in federal and state courts, as well as various administrative agencies. Mr. DeBlasio has conducted multiple jury trials with successful outcomes for employers. Mr. DeBlasio also negotiates and enforces employment agreements and restrictive covenants, and provides proactive counseling to employers, helping them navigate the many different issues relating to compliance with federal and state anti-discrimination, whistle-blower and medical leave statutes. Mr. DeBlasio frequently speaks at local and national conferences and seminars dealing with employment-related issues, and conducts sensitivity training programs for our clients' employees. In 1993, Mr. DeBlasio received a bachelor of arts degree from Flagler College in St. Augustine, Florida and in 1996 he received a doctor of jurisprudence degree (J.D.) from Louisiana State University in Baton Rouge, Louisiana. He has counseled commercial tenants, landlords, real estate developers, real estate investment trusts and institutional investors on the acquisition, disposition, development, financing, management and leasing of commercial real estate as well as real estate matters related to mergers and other commercial transactions. Mr. Murphy has represented both landlords and tenants in connection with leases and subleases, including for office, warehouse, retail and industrial space. During Law School, Mr. Murphy served as a member of the Journal of International Law and Commercial Regulation. Prior to attending law school, Mr. Murphy worked as an investment accountant with the Prudential Insurance Company of America.
During her twenty years of practice, Karen Painter Randall has demonstrated her dedication to adhering to the highest principles and standards of the legal profession and service to the community. Ms. Randall joined Connell Foley as an associate in 1986, and became a partner in 1992. She presently serves as Chair of the Defense Division of the Directors and Officers Litigation Department at Connell Foley. In addition, she is Co-Chair of the Professional Liability and Tort Law Department. Mr. Gennaro primarily practices in the area of insurance law litigation, with a focus on Director and Officer insurance law. Mr. Gennaro is the co-author, along with Partner Jeffrey O'Hara, of the article "Be Wary of Independent Tort Claims for Spoliation of Evidence," published in the July 2004 issue of For The Defense. For The Defense is published by The Defense Research Institute (DRI), the national association of defense trial lawyers and corporate counsel, comprised of 22,000 members. For The Defense is DRI's flagship publication, distributed monthly to all members and sitting judges throughout the United States. In addition, Mr. Gennaro and Mr. O'Hara are the authors of the Special Feature Article "The Duty Of Corporate Counsel To Preserve Evidence," published in the September 2004 issue of The Metropolitan Corporate Counsel.

Mr. Shadiack is a member of the firm's labor and employment law practice group, who practices exclusively in the areas of labor and employment law on behalf of management in the private and public sectors. Mr. Shadiack represents employers in litigation in state and federal courts, and in matters before state and federal administrative agencies. He also represents employers during contract and grievance arbitrations, in defending unfair practice charges, and in connection with employee disciplinary appeal hearings. Ms. Tantalla focuses her practice on environmental related issues and has assisted in matters involving site remediation, cost recovery, insurance coverage compliance and regulatory issues, natural resource damages and has extensive knowledge of state and federal regulations. She is an active litigator in state and federal courts and has represented clients in a variety of matters, including commercial disputes, product liability claims, mass litigation and environmental litigation, regulatory and compliance matters. Ms. Tantalla received her Juris Doctor degree and Master of Studies in Environmental Law from Vermont Law School. While attending law school, Ms. Tantalla served as Managing Editor of the Law Review. Ms. Edwards has extensive, sophisticated experience in obtaining financing for development of brown field sites and public projects as well as in the acquisition, development, financing, leasing and sale of commercial real estate. Her expertise lies in structuring, negotiating and documenting the borrowing of federal and state funds and the acquisition, development, financing and lease-up of mixed-use and multi-owner sites. Her areas of concentration include the representation of borrowers in obtaining financing under the New Jersey Environmental Infrastructure Trust/Fund Loan Program which finances landfill closures, clean-up of brownfields and contaminated properties, water-quality-justified land acquisition, construction of and upgrades to storm water management systems, wastewater treatment facilities, sludge handling facilities, and drinking water projects. She also represents the issuers, underwriters and borrowers in municipal and public authority bond transactions and has extensive experience in securitized portfolio capital market financing, ground and space leasing, registration of condominiums and age-restricted retirement communities with the New Jersey Department of Community Affairs, multi-state site acquisitions and workouts of defaulted debt. Ms. Edwards has provided legal advice to numerous private investors, owners, tenants and lenders, and public authorities including Rahway Valley Sewerage Authority, ABB, Allied Partners, Bally Gaming, Boston Properties, Cablevision, ProLogis, Hartz Mountain, Kimco, MoMA, and MONY and Tropicana.
Mr. McGloin won First Place in the Nathan Baker Mock Trial Competition in 1991. He was a Member of the Rutgers Law School National Mock Trial Team.
