Richard J. Gering, Ph.D, a Principal in Parente Randolph, LLC's Philadelphia office, was among a group of distinguished professionals who were presenters at Law Seminars International's recent two-day conference. The conference, which was held at the Club Quarters Hotel in Philadelphia on October 30 and 31, focused on Calculating and Proving Patent Damages. The conference provided an in-depth look at the techniques used by successful trial lawyers and damages experts to obtain relevant information and determine whether damages include lost profits. Factors which were discussed included the size of the market in which the infringer competes, the number of competitors in that market, sales lost by the patent holder to the infringer and the amount of price erosion as a result of the infringer's activities. Recent successful practices in calculation of a reasonable royalty were also discussed. Gering's topic, Lost Profit Damages: The Effects of Non-Infringing Alternatives (Substitutes and Complements), Price Erosion and Convoyed Sales Analysis, addressed economic perspectives on price erosion and lost convoyed sales and lost profits when the patent is only part of the product or technology at issue. In his position with Parente Randolph, Gering focuses on all forms of Intellectual Property and quantifies economic damages in the form of lost profits, reasonable royalties, price erosion, convoyed sales, and defendants' profits in Patents, Trademarks, Copyright, Trade Dress and Trade Secrets matters. Gering is currently an Adjunct Lecturer in Law at Villanova University School of Law where he teaches "Litigation Strategy." He has presented seminars to organizations such as the ABA , AICPA and AIPLA on a variety of topics and has published on subjects such as trademarks, lost profit methodology, patent infringement damages and intellectual asset management.
